1. Scope
This policy applies to PhotoGPT and PhotoGPT AI, operated by TAIC LLC. It forms part of our Terms of Service. Terms such as Services, Inputs and Outputs have the meanings given there. Our Privacy Policy explains how we process content, reports and account information.
These rules apply to prompts, uploaded photographs, images and videos, reference and training material, editing instructions, generated results and content shared through available public features. They apply across models and plans, including private generation, public sharing and any offering or sale of content through the Services. You must not assist others to violate them. The Services are for adults aged 18 and over; prohibited adult content remains prohibited regardless of the user's age or consent.
2. Prohibited content and uses
You must not use the Services or assist others to:
- Break the law or infringe copyright, trademarks, confidentiality, privacy, publicity or other rights.
- Create, request, possess, distribute or facilitate child sexual abuse or exploitation material, including real, altered or synthetic depictions, or sexualize anyone under 18; facilitate child grooming, sexual solicitation, enticement or trafficking.
- Upload, request, generate, edit, publish, distribute, offer or sell pornography, sexually explicit material, sexualized nudity, depictions of sexual acts, fetish content or other adult content intended for sexual gratification, whether real, altered or AI-generated.
- Create or use nonconsensual intimate imagery, sexual deepfakes, exploitative depictions or tools and edits intended to undress a person or remove clothing for sexual purposes. A person's consent does not override the prohibition on adult sexual content.
- Impersonate people without authorization, fabricate endorsements, commit identity theft or fraud, forge official documents or produce deceptive election-related material.
- Harass, threaten, stalk, discriminate, promote hateful abuse or violence, or facilitate self-harm or dangerous criminal conduct.
- Submit another person's likeness, voice, private communications or sensitive personal information without the necessary permission and lawful basis.
- Misrepresent AI-generated material as authentic evidence of an event or omit legally required synthetic-media disclosures. Do not remove legally required provenance or safety markings.
- Deploy Outputs as the sole basis for decisions about employment, credit, insurance, housing, education, health, legal status or similarly consequential matters, or use the Services as a substitute for qualified professional advice.
- Introduce malware, probe systems without authorization, scrape at scale, overload the Services, bypass payment or safety controls, exploit vulnerabilities or access another user's content.
- Reverse engineer or extract proprietary systems or model weights, except where applicable law expressly permits it; use automated access unless we authorize it; or use the Services to train a competing model where prohibited by disclosed supplier restrictions or our express feature terms.
- Manipulate reviews, send spam, misuse promotions or evade usage limits, bans or geographic restrictions.
These restrictions apply to prompts, source uploads, Outputs, public content and other activity, whether or not content is published. We may refuse requests and restrict unsafe features consistent with this policy, our Terms and applicable law.
3. Generation safety
Our safety rules apply to text prompts, source images and videos, other Inputs and generated Outputs. We and our processing providers may use automated filters and authorized human review to identify prohibited requests or content. We may refuse processing, stop a generation or withhold an Output that violates this policy or our Terms. Provider-specific safeguards also apply, and you must not bypass them. You remain responsible for complying with this policy and our Terms even if a request or result passes a safety filter. We do not promise that every harmful request or result will be detected.
4. Public-content moderation
Content you publish through a public feature remains subject to this policy and our Terms. We review reports and may remove, hide or disable access to public content that violates this policy or our Terms, infringes rights or creates a safety risk. We may also act on violations we identify without receiving a report.
5. Report content or misuse
Anyone, including a person without a PhotoGPT account, may report unsafe generations, source uploads, public content or suspected misuse by emailing support@photogptai.com with the subject "Safety report." Include the relevant URL or job ID, if available, and a brief explanation of the concern. If neither is available, provide enough information for us to try to locate the content. Do not download, redistribute or attach suspected child sexual abuse material to an email. We review reports and take action appropriate to the risk and applicable legal requirements. Do not knowingly submit false reports or retaliate against reporters.
6. Enforcement and child safety
For violations, we may remove content or disable access to it, restrict account features, suspend accounts or permanently ban accounts. We determine the action according to the seriousness, risk and recurrence of the violation and applicable law. Serious child-safety violations may result in an immediate permanent ban. Do not evade a restriction or ban by using another account.
We report apparent child sexual exploitation to NCMEC's CyberTipline and other competent authorities where required by law, and preserve relevant information as legally required. We retain records subject to lawful preservation duties even after restricting or removing access to the content.
7. Notice and appeals
If we take action against your account or content, we will explain the reason and available review route where legally required and where doing so would not compromise safety, security or an investigation. To appeal, email support with the subject "Moderation appeal," the account identifier, the decision and relevant context. We may preserve records and report suspected illegal activity where required or permitted by law.
8. Nonconsensual intimate image removal
If an intimate image or video depicting you was published through the Services without your consent, you or your authorized representative may email support@photogptai.com with the subject "Intimate image removal." This includes qualifying AI-generated or altered depictions. No PhotoGPT account is required. Include your physical or electronic signature, information sufficient to identify and locate the depiction, a brief good-faith statement explaining the lack of consent to publication and relevant circumstances, and contact information. A URL or job ID helps us locate it. Do not attach suspected child sexual abuse material.
Where the TAKE IT DOWN Act applies to us and the request, we remove the reported depiction as soon as possible and no later than 48 hours after receiving a valid request, and make reasonable efforts within that period to identify and remove known identical copies. Other applicable removal duties also remain in effect. This process is separate from copyright notices, appeals and ordinary account deletion; the one-month deletion period in our Privacy Policy does not delay urgent or legally required removal.
9. Changes and contact
Changes to this policy follow the notice and acceptance provisions in Section 23 of our Terms of Service. For safety concerns, removal requests or appeals, contact support@photogptai.com using the instructions above.
